These Terms of Service ("Terms") govern your use of the Gorilla Pop Protectors website, online store, products and related services.

In these Terms, "Gorilla Pop Protectors", "Gorilla", "we", "us" or "our" refers to the business operating the Gorilla Pop Protectors online store, and "you" or "your" refers to any person accessing our website or purchasing products from us.

1. About Gorilla Pop Protectors

Gorilla Pop Protectors is an online retailer specialising in Funko Pops, collectible products and protective display solutions such as Pop Protectors, Hardstacks and acrylic displays.

Our website is operated using Shopify, which provides the ecommerce platform that enables us to sell our products and provide our online services.

Purchases made through our website are transactions between you and Gorilla Pop Protectors. Shopify provides the technology and ecommerce infrastructure but is not the seller of the products offered by Gorilla Pop Protectors.


2. Eligibility and Use of Our Website

You may use our website for lawful purposes and in accordance with these Terms.

By using our website or placing an order, you confirm that:

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and other information displayed on our website are accurate and up to date.

However, photographs and colours may appear slightly different depending on your monitor, screen, device settings, lighting or photographic conditions.

Minor differences between product photographs and the actual product do not necessarily constitute a defect.

Product availability may change without notice, particularly because we sell collectibles that may be discontinued, limited, rare or manufactured many years ago.

Some products may therefore become unavailable after being listed or after an order has been placed.

Where a product becomes unavailable before we are able to fulfil an accepted order, we will contact you and provide the appropriate resolution in accordance with applicable law.


4. Collectible Products

Gorilla Pop Protectors specialises in collectible products, and collectible condition can be different from ordinary retail merchandise.

Some Funko Pops and other collectibles may have:

  • Minor box imperfections;

  • Manufacturing variations;

  • Printing variations;

  • Small marks or imperfections resulting from the manufacturing or distribution process;

  • Packaging imperfections;

  • Age-related characteristics where applicable.

Unless a product is specifically advertised as being in mint condition, we do not guarantee that a collectible or its packaging will be completely free from minor imperfections.

Where a product is specifically described as having a particular condition, that description will form part of the basis on which the product is offered for sale.

If you require additional photographs or information regarding the condition of a particular collectible, please contact us before placing your order.

Nothing in this section limits any statutory rights relating to goods that are genuinely defective, unsafe, incorrectly described or otherwise non-conforming.


5. Rare, Discontinued and Limited Collectibles

Because we sell collectibles, the availability and market value of certain products may change substantially.

Some items may have been manufactured many years ago and may no longer be produced.

Other products may become more valuable because of:

  • Rarity;

  • Limited production;

  • Discontinuation;

  • Collector demand;

  • Age;

  • Scarcity; or

  • Other market conditions.

Gorilla Pop Protectors does not guarantee that an identical replacement will be available for a collectible after purchase.

Where a qualifying product requires replacement and an identical replacement cannot reasonably be sourced, the applicable remedy will be handled in accordance with our Return and Refund Policy and applicable South African law.


6. Product Pricing

All prices displayed on our website are stated in South African Rand (ZAR) unless otherwise indicated.

The price applicable to a product will generally be the price displayed at the time the order is placed and confirmed.

Prices, promotions and discounts may change from time to time.

We may offer promotional pricing subject to additional terms and conditions. Where specific promotional terms conflict with these Terms, the promotional terms will apply to that promotion to the extent permitted by law.

We will not use an obvious pricing error to mislead consumers.

If an obvious error in pricing or product information occurs, we may contact you to clarify the error before processing the order, subject to applicable law.


7. Orders and Acceptance

When you place an order through our website, you are submitting an order to purchase the selected products.

An order is subject to product availability and payment being successfully authorised.

We may use third-party courier and logistics providers, including The Courier Guy, Aramex and Pargo, depending on the order, destination, service availability and our operational requirements.

For door-to-door deliveries, Gorilla Pop Protectors may choose between available courier providers based on factors such as destination, service availability, delivery requirements and operational considerations.

Delivery times are estimates unless a specific delivery commitment has been expressly agreed.

Courier delays may occur due to circumstances outside our reasonable control, including:

  • Weather;

  • Road conditions;

  • Remote or outlying delivery locations;

  • High courier volumes;

  • Public holidays;

  • Operational disruptions;

  • Incorrect or incomplete delivery information;

  • Events outside our reasonable control.

Nothing in our Shipping Policy or these Terms limits any consumer right that cannot lawfully be excluded under South African law.


10. Risk During Delivery

Risk relating to products during delivery will be determined in accordance with applicable South African consumer law.

Nothing in these Terms transfers or excludes a risk or statutory responsibility in a manner that is prohibited by applicable law.

Where products are damaged, lost or incorrectly delivered, we will investigate the matter and assist with the appropriate courier claim or other remedy where applicable.

11. Returns, Refunds and Exchanges

Returns, refunds and exchanges are governed by our Return and Refund Policy, which forms part of these Terms.

Our Return and Refund Policy explains:

  • Our 7-day reporting period;

  • Defective and non-conforming products;

  • Products damaged during delivery;

  • Customer-caused damage;

  • Funko Pop box condition;

  • Wrong or missing items;

  • Refunds;

  • Store credit;

  • Exchanges;

  • Rare and discontinued collectibles; and

  • Change-of-mind returns.

Because Gorilla Pop Protectors sells collectibles, Funko Pops and other collectible items generally cannot be exchanged simply because a customer wants a different item.

Identical replacements may also not be available for rare, discontinued or older collectibles.

Pop Protectors may generally be exchanged subject to availability and the applicable circumstances.

Nothing in our Return and Refund Policy or these Terms limits statutory consumer rights.


12. Change-of-Mind Purchases

Gorilla Pop Protectors does not voluntarily offer general change-of-mind returns.

This means that, unless a statutory cancellation or return right applies, we do not accept returns simply because a customer:

  • Changed their mind;

  • No longer wants the product;

  • Found the product cheaper elsewhere;

  • Decided they do not like the product;

  • Ordered the wrong product;

  • Changed their collecting plans; or

  • No longer requires the product.

Any statutory cancellation, cooling-off or return right that applies under South African law remains unaffected.

Gorilla Pop Protectors uses Shopify to operate and host its online store.

Shopify provides the technology and ecommerce infrastructure through which our website and online store operate.

However, the purchase of products from Gorilla Pop Protectors is a transaction between you and Gorilla Pop Protectors.

Shopify is not the seller of our products and does not replace Gorilla Pop Protectors as the supplier to the customer.
